Transferee of nursing home ownership must obtain a new probationary license and notify the Department at least 30 days prior to final transfer of ownership.

Transferor must notify the Department at least 30 days before transfer and remains responsible for facility operations until transferee receives a license.

Transferee and transferor must jointly submit a transition plan to the Department detailing how resident care and staffing levels will be maintained during the ownership change.

Department must accept or reject the transition plan within 10 days; if rejected, the Department shall work with parties to bring it into compliance.

If either party fails to follow the accepted transition plan and actual harm to a resident occurs, the Department shall issue a high-risk designation and violation to the responsible entity.
