Licensed substance use disorder facilities must provide verbal notice to a patient's personal representative within 24 hours of the patient's death and written notice within 5 days.

Licensed mental health and developmental disabilities facilities must provide verbal notice to a service recipient's personal representative within 24 hours of death and written notice within 5 days.

Notice requirements apply only when the personal representative is known and must comply with federal regulations under 42 CFR 2.15(b), 45 CFR 164.502(g), and the Mental Health and Developmental Disabilities Confidentiality Act.

"Personal representative" is defined according to 45 CFR 164.502(g) for purposes of these notice requirements.

The Act is known as Jordan's Law.
