SB3154 - Affordable Drug Manufacturing Act

• Creates the Affordable Drug Manufacturing Act requiring the Department of Public Health to enter into partnerships to increase competition, lower prices, and address shortages in the generic prescription drug market effective July 1, 2024.

• Department must prioritize generic prescription drugs for chronic and high-cost conditions, with at least one form of insulin included if a viable manufacturing pathway exists, and make drugs available at transparent prices without rebates except federally required ones.

• Department shall consult with public agencies, health insurers, hospitals, and pharmacy benefit managers to develop lists of targeted drugs and determine procurement volumes over multiyear periods to support lower-cost markets.

• Requires Department to submit a feasibility report by July 1, 2026 assessing direct manufacturing options and governance structures, and a status and analysis report by July 1, 2025 describing targeted drugs and analyzing impacts on competition, access, and costs.

• Amends the Freedom of Information Act to exempt all nonpublic information and documents obtained under this Act from disclosure requirements.
