• Amends the Freedom of Information Act to add data or information provided pursuant to Section 20 of the Statewide Recycling Needs and Assessment Act as an exemption from public disclosure.

• Requires an independent certified public accounting (CPA) firm to collect data from entities needed for the statewide recycling needs assessment under nondisclosure agreements that prevent identification of data sources.

• Extends the deadline for the Agency to select a qualified consultant to conduct the statewide needs assessment from July 1, 2024 to January 1, 2025.

• Extends the deadline for finalizing the needs assessment from May 1, 2026 to November 1, 2026, with draft submission to the Advisory Council by June 30, 2026.

• Requires the solicitation and contract for the needs assessment to specify that collected data and information must be used exclusively for completing the assessment and no other purposes.
