Municipalities with populations of 1,000,000 or greater may not pass ordinances prohibiting video gaming; prohibition is only allowed through referendum.

Home rule powers are preempted for municipalities with populations of 1,000,000 or greater regarding video gaming regulation.

A 34% tax on net terminal income is imposed in municipalities with populations of 1,000,000 or greater, with 83% distributed to the Regional Transportation Authority and 17% to the municipality where the terminal is located.

Municipalities with populations under 1,000,000 may continue to pass ordinances prohibiting video gaming through the existing process.

Qualified fraternal and veterans organizations may apply for video gaming licenses in municipalities or counties with populations under 1,000,000 that have enacted video gaming prohibitions.
