SB3181 - Appliance Standards Act

• Creates the Appliance Standards Act requiring the Illinois Environmental Protection Agency to adopt minimum efficiency standards for 13 covered product categories including faucets, showerheads, water closets, urinals, computers, irrigation controllers, gas fireplaces, and water coolers by one year after the effective date.

• Establishes specific efficiency standards for covered products, including water flow rates for faucets (1.5 GPM for private lavatory, 1.8 GPM for kitchen, 0.5 GPM for public), showerheads (2.0 GPM at 80 PSI), and water closets (1.28 gallons per flush).

• Requires manufacturers to test products, certify compliance to the Agency or approved third parties, and label compliant products; allows the Agency to test products and charge manufacturers for non-compliant items discovered during testing.

• Prohibits sale of non-compliant covered products in Illinois beginning January 1, 2026, and prohibits installation for compensation beginning January 1, 2027; exempts products manufactured in-state for out-of-state sale and products for mobile homes or recreational vehicles.

• Establishes enforcement mechanisms including warnings for first violations, civil penalties up to $100 for second violations and up to $500 for subsequent violations, with each product and each day of violation treated as a separate offense; allows Attorney General to seek injunctions for repeated violations.
