IL SB3183

Amends the Juvenile Court Act of 1987 and the Adoption Act to change references from "reasonable efforts" to "active efforts" in cases involving child reunification, defining "active efforts" as affirmative, active, thorough, timely efforts representing a higher standard than reasonable efforts.

Requires courts to specify in writing which parties failed to make active efforts and the applicable time periods when making findings that the Department of Children and Family Services has not met this standard in service plan reviews.

Prohibits finding a parent unfit solely because the Department failed to make active efforts as defined in the Juvenile Court Act, and protects parents from unfitness findings for failure to make reasonable progress during any 9-month period when a court found the Department failed to make active efforts.

Applies the active efforts standard to the Department's obligations in temporary custody hearings, disposition hearings, and permanency hearings to provide services as outlined in case service plans.

Provides that this protection applies only to findings of failure to make active efforts made on or after the effective date of the bill.
