IL SB3212

Creates a "Real Property of Small Value Affidavit" procedure allowing interested persons to transfer real property from a decedent's estate without full probate if fair market value does not exceed $350,000.

Requires filing the affidavit in circuit court no sooner than 6 months after the decedent's death, in either the county where the decedent was domiciled or where Illinois real property is located.

Exempts property owned in joint tenancy, tenancy by the entirety, with a life interest, or governed by a transfer on death instrument from this procedure.

Requires the affidavit to state that either no letters of office are outstanding and no petition is pending, or the personal representative has consented in writing.

Requires certification that funeral expenses, last illness expenses, and all unsecured debts have been paid, with notary acknowledgment for each person executing the affidavit.
