SB3228 - Genetically Engineered Food Labeling Act

• Requires food offered for retail sale in Illinois to be labeled as "Genetically Engineered" if entirely or partially produced with genetic engineering, effective January 1, 2025.

• Raw agricultural commodities must display labeling on package front or retail shelf; processed foods must be labeled "Produced with Genetic Engineering" or "Partially Produced with Genetic Engineering" on front or back of package.

• Exempts organic certified foods, foods from animals not genetically engineered (regardless of feed), foods with only processing aids/enzymes from genetic engineering, alcoholic beverages, medical foods, and foods served in restaurants from labeling requirements.

• Allows manufacturers and retailers to rely on sworn statements from suppliers attesting food was not knowingly or intentionally genetically engineered and was properly segregated, or on independent testing following internationally recognized standards.

• Provides private right of action for Illinois citizens after 60-day notice to Attorney General; prevailing plaintiffs may recover attorney's fees but not monetary damages; farmers exempt from liability unless also acting as retailers or manufacturers.
