IL SB3248

Establishes the "No AI FRAUD Act" to protect individuals' property rights in their own voice and likeness by creating a private cause of action against unauthorized use of digital voice replicas or digital depictions created with artificial intelligence or similar technology.

Prohibits distributing personalized cloning services, publishing digital voice replicas or digital depictions without consent, or materially facilitating such conduct, with statutory damages of $50,000 per violation for cloning services or $5,000 per violation for digital replicas/depictions, plus actual damages, profits, and potential punitive damages and attorney's fees.

Establishes that voice and likeness rights are intellectual property that survive death for 10 years (or longer if actively commercialized), are freely transferable, and require written consent and legal representation for authorized use in advertisements or expressive works.

Permits First Amendment protections as a defense by balancing public interest against intellectual property rights, and provides that users are not liable if harm is negligible, except for content involving child sexual abuse material, sexually explicit content, or intimate images which constitute per se harm.

Becomes operative 180 days after enactment and does not preempt other state laws protecting individuals' names, voices, or likenesses, with a four-year statute of limitations for civil actions.
