IL SB3250

Amends the Statute on Statutes (5 ILCS 70/1.36) to define terms "person," "human being," "child," and "individual" to include every infant member of the species homo sapiens who is born alive at any stage of development.

Defines "born alive" as complete expulsion or extraction from the mother at any stage of development where the infant breathes or has a beating heart, pulsation of the umbilical cord, or definite movement of voluntary muscles, regardless of whether the umbilical cord has been cut or whether birth results from natural labor, induced labor, cesarean section, or induced abortion.

Establishes that a live child born as a result of an abortion shall be fully recognized as a human person and accorded immediate protection under the law.

Removes three existing provisions that previously stated the statute would not affirm or deny legal status prior to birth, would not affect existing federal or state abortion law, and would not alter generally accepted medical standards.

Takes effect immediately upon enactment.
