SB3272 - Warehouse Worker Protection Act

• Creates the Warehouse Worker Protection Act effective January 1, 2025, establishing worker protections for employees at warehouse distribution centers employed by employers with 100+ employees at a single location or 1,000+ employees statewide.

• Requires employers to provide written disclosure of all quotas to employees upon hire or within 30 days of the Act's effective date, including quantified task numbers, materials to be produced, time periods, and potential adverse employment actions for non-compliance, with updates required within 2 business days of any quota changes.

• Prohibits quotas that prevent employees from taking meal and rest periods or accessing bathroom facilities with reasonable travel time; employers cannot take adverse employment action for failure to meet impossible quotas or undisclosed quotas.

• Requires employers to maintain records for 3 years and provide employees with personal work speed data and aggregated comparative data within 3 calendar days of request at no cost; establishes a rebuttable presumption of unlawful retaliation if adverse action occurs within 90 days of an employee requesting quota information or filing complaints.

• Provides employees and their representatives with private right of action for injunctive relief and attorney's fees; authorizes the Department of Labor and Attorney General to enforce the Act and investigate workplaces with injury rates 1.5 times higher than warehousing industry average.
