IL SB3307

Amends the Illinois Insurance Code to require health insurance issuers to include expenditures for covered items or health care services that fall within essential health benefits categories when calculating annual out-of-pocket cost-sharing limitations, regardless of whether the issuer classifies them as essential health benefits.

Applies this requirement to both ancillary services provided by nonparticipating providers at participating health care facilities and non-emergency covered health care services when notice and consent criteria are not satisfied.

Requires the same calculation methodology for annual cost-sharing limitations under 42 U.S.C. 18022(c) and 42 U.S.C. 300gg-6(b), ensuring consistent treatment of covered services.

Takes effect immediately upon enactment.
