SB3358 Summary

• Creates a new "distillery shipper's license" allowing Illinois distillers, craft distillers, and out-of-state distillers licensed in other states to ship spirits directly to Illinois residents age 21+ for personal use only, not for resale.

• Limits direct shipments to no more than 12 cases of spirits per year per resident and requires prominent labeling on shipping containers stating alcohol content and age verification requirements.

• Requires distillery shippers to pay state liquor gallonage tax and use tax on all spirits shipped to Illinois residents, and to collect and submit shipment data to the State Commission semi-annually.

• Adds distillery shipper's license to the fee schedule with fees of $200 for online renewal and $350 for initial license (under 100,000 gallons) or $1,200 online renewal and $1,500 initial license (100,000 gallons or over).

• Preempts home rule authority on delivery regulations for distillery shipper licensees and subjects violators to investigation and enforcement by the Illinois Liquor Control Commission.
