Department of Children and Family Services must adopt rules by January 1, 2026 regarding parental liability for child care and training costs, establishing standards based on ability to pay using annual income and family size.

State policy prohibits referral of foster care cases for child support enforcement services until the court rules out the permanency goal of return home under the Juvenile Court Act of 1987.

Department may refer cases for child support enforcement services after the return home goal is ruled out by the court, and must adopt rules by January 1, 2026 establishing additional policies and criteria for such referrals consistent with federal law.

Parents receiving Title IV-E foster care maintenance payments are deemed to have assigned their child support rights to the Department upon referral for enforcement, making support obligations collectible by the State.

Acceptance of children for services or care cannot be limited or conditioned on parents' or guardians' financial status or ability to pay.
