SB3370 Summary

• Creates the Illinois Law Enforcement Standards Appeal Board within the Illinois State Police to hear appeals of decisions made by the Illinois Law Enforcement Training Standards Board, with an 11-member board appointed by legislative leaders, the Governor, and the Attorney General.

• Establishes the Illinois Law Enforcement Standards Appeal Fund, with 1.5% of each deposit into the Traffic and Criminal Conviction Surcharge Fund transferred to support the Appeal Board's operations.

• Modifies the Illinois Police Training Act to replace 6 appointment positions on the Training Standards Board with new requirements for collective bargaining unit members and other representatives, and requires all board vacancies to be filled within 90 days.

• Prohibits the Training Standards Board from disclosing officer certification or decertification information until decisions are final and all appeals exhausted; allows officers to seek damages of 5 times actual damages plus costs for violations of this confidentiality requirement.

• Adds provisions for officer certification to remain valid for one year after departure from employment in good standing, clarifies denial of certification procedures, and implements federal Law Enforcement Officer Safety Act of 2004 requirements.
