SB3392 Summary

• Increases minimum jail time for first violation of civil no contact orders, orders of protection, and protective orders from 24 hours to 48 hours imprisonment.

• Increases minimum jail time for second or subsequent violations of protective orders from 48 hours to 96 hours imprisonment.

• Courts are encouraged (but not required) to impose these minimum penalties unless explicitly finding that such imprisonment would be manifestly unjust.

• Applies to violations of civil no contact orders under the Civil No Contact Order Act, orders of protection under the Illinois Domestic Violence Act of 1986, and protective orders under the Code of Criminal Procedure of 1963.

• Allows courts to consider violations when modifying conditions of pretrial release, revoking probation, or modifying sentences on underlying criminal charges.
