Distributors, secondary distributors, and retailers selling electronic cigarettes must obtain manufacturer certifications stating the products are not adulterated before sale or distribution in Illinois.

Sellers must maintain copies of manufacturer certifications for at least 2 years and produce them upon request by the Department of Revenue, Attorney General, or enforcement entities.

Manufacturers are prohibited from providing false or misleading statements in certifications regarding product safety and FDA approval status.

Violations of certification requirements are subject to license suspension or revocation and civil penalties up to the greater of 500% of retail value or $10,000.

Electronic cigarettes sold in violation of these requirements are considered contraband subject to seizure and forfeiture.
