SB3464 - Work Without Fear Act

• Creates prohibition on "immigration-related retaliation" by employers against workers or their family members who exercise rights under state employment laws, including contacting immigration authorities, misusing E-Verify, unfair document practices, or filing false police reports.

• Establishes Department of Labor enforcement authority to investigate complaints filed within one year, subpoena witnesses and documents, take complaints on behalf of workers, and order license suspensions for violations.

• Allows Attorney General to initiate or intervene in civil actions against violators and conduct investigations with subpoena power.

• Provides private right of action for workers to sue in circuit court within two years for back pay, front pay, liquidated damages of $30,000, civil penalties up to $10,000, attorney's fees, and equitable relief.

• Imposes additional civil penalties of $25,000 per first violation and $50,000 per repeat violation within 5 years, with license suspension for up to 14 days (first violation), 30 days (second), or 90 days (third and subsequent violations).

• Effective January 1, 2025.
