Applicants for new assisted living and shared housing facilities, or major alterations/additions, must submit architectural drawings and specifications to the Department of Public Health for review and approval before construction begins.

Department must notify applicants within 10 business days whether submissions are complete or incomplete; failure to notify results in automatic deemed-complete status, triggering a 60-day review period for approval or disapproval.

Construction is deemed approved if the Department fails to approve or disapprove within 60 days of submission completion; applicants may request reconsideration of disapprovals with final decisions within 45 days.

Department shall charge tiered fees based on project value, ranging from no fee for projects under $50,000 to a maximum of $35,000 for projects exceeding $5,000,000; fees are deposited into a dedicated Health Facility Plan Review Fund for review costs only.

Department must conduct on-site inspection within 30 business days of project completion and issue occupancy approval within 5 business days if substantial compliance is demonstrated; occupancy is prohibited until approval is received, unless the Department misses required timelines.
