SB3543 Summary

• Creates the Military Installation and Critical Infrastructure Protection Act, effective July 1, 2024, prohibiting foreign principals from designated adversary countries (China, Russia, Iran, North Korea, Cuba, Venezuela, Syria) from owning agricultural land or holding greater than 25% interest in such land in Illinois.

• Bans foreign principals from adversary nations from purchasing, leasing, or controlling property within 25 miles of military installations, with existing violating agreements voided and a 180-day divestment deadline.

• Prohibits entities with significant access to critical infrastructure from entering agreements with or using products from foreign adversary principals, unless pre-approved by Illinois Emergency Management Agency when no reasonable alternatives exist.

• Requires companies accessing critical infrastructure to file certification forms, identify employee positions with access, conduct background checks on employees, and prohibit foreign nationals from adversary nations from accessing such infrastructure.

• Establishes whistleblower rewards equal to 30% of land sale proceeds from violations, allows the Illinois Attorney General to pursue judicial foreclosure for non-compliance, and bans software produced by or in foreign adversary countries from use in State infrastructure.
