Amends the Transportation Benefits Program Act to add a definition of "construction industry" covering activities such as constructing, altering, repairing, demolishing, landscaping, painting, and related work on buildings, highways, bridges, sewers, and other structures

Construction industry definition also includes moving construction-related materials on job sites, snow plowing, snow removal, and refuse collection

Covered employers must be located in specific geographic areas including Cook County and designated townships in Lake, Will, DuPage, Kane, McHenry, and other collar counties

Employers with 50 or more full-time employees (averaging 35+ hours per week) located within one mile of fixed-route transit service are subject to the Act's requirements

Collective bargaining agreements in effect when the Act took effect remain valid, and requirements may be waived through explicit, clear, and unambiguous terms in future collective bargaining agreements
