IL SB3559

Amends the Nursing Home Care Act to prohibit retaliation against nursing home residents for complaining about facility practices they believe violate laws or regulations or are problematic.

Protects residents who disclose concerns to supervisors or public bodies, testify in investigations, assist in enforcement proceedings, seek transition to independent living, request care-related accommodations, or join resident councils or unions.

Defines retaliatory action against residents as reduced access to services, neglect, selective restrictions, adverse actions affecting quality of life, or threats of such actions.

Allows residents to establish retaliation as a prima facie case within one year of protected conduct; facilities may defend by proving clear and convincing evidence they would have taken the same action regardless.

Permits residents to recover injunctive relief, two times the monthly billing amount for that resident, and reasonable costs and attorney's fees; claims may be filed in any court of competent jurisdiction or state administrative hearing process.
