SB3562 - Including Families in Mental Health Recovery Act

• Department of Human Services must adopt rules within one year clarifying when Illinois health care providers may disclose protected mental health information consistent with HIPAA privacy and security standards.

• Rules shall address disclosure circumstances including: communicating with family/caregivers about treatment and side effects, assessing patient capacity to consent, sharing information when patient consents or lacks capacity but disclosure is in patient's best interest, and involving family in care plans.

• Rules shall permit disclosure to family members, law enforcement, or others when patient presents serious and imminent threat of harm to self or others, and regarding admission or release of patients on emergency psychiatric holds.

• Department must develop and disseminate model training programs and materials within one year for health care providers, legal professionals, and patients/families regarding circumstances for disclosing mental health information with and without patient consent.

• Department shall solicit input from relevant national, state, and local organizations when developing the required model programs and training materials.
