Prohibits advertising, distributing, marketing, offering for sale, or selling electronic cigarettes or alternative nicotine products using foods (cake, candy, cupcake, pastry, pie), characters or symbols known to appeal to minors (celebrities, comic book characters, mythical creatures), or school supplies (erasers, highlighters, pens, pencils) in trademarks, advertising, branding, packaging, or marketing.

Establishes that a person who knowingly violates the prohibition on youth-appealing marketing is guilty of a Class A misdemeanor.

Adds the new prohibition to the list of violations that law enforcement officers may investigate and seize products for, with specific reference to subsection (a-10).

Makes violation of the youth-appealing marketing provision a Class A misdemeanor offense, carrying more severe penalties than other tobacco sales violations which are petty offenses.

Becomes effective immediately upon passage.
