IL SB3596

Creates the Immigration Enforcement Act prohibiting State entities, local entities, and law enforcement agencies from adopting policies that restrict or prohibit compliance with federal immigration laws.

Requires law enforcement agencies to notify courts of immigration detainers, record them in case files, and comply with facially sufficient detainers; mandates county jails, municipal jails, and Department of Corrections to enter agreements with federal immigration agencies for housing detainees.

Establishes the Asylum Travel Expense Program in the Department of Human Services providing transportation assistance to noncitizens seeking asylum in Illinois to relocate to other states or their country of origin using the cheapest available transportation method.

Transfers $10,000,000 from the General Revenue Fund to the Asylum Travel Expenses Fund on July 1, 2024 to support the program.

Repeals the Illinois TRUST Act and modifies the Illinois Identification Card Act and Vehicle Code to restrict facial recognition and information sharing with immigration agents without court orders, warrants, or subpoenas; declares immigration enforcement regulation an exclusive State power, limiting home rule authority.
