IL SB3705

Creates the Digital Voice and Likeness Protection Act to render unenforceable any agreement provision allowing creation and use of a digital replica of an individual's voice or likeness to replace in-person work performance.

Provision is unenforceable only if it fails to clearly define and detail all proposed uses of the digital replica or generative artificial intelligence system.

Provision is unenforceable only if the individual was not represented by legal counsel who negotiated digital replica licensing terms in a standalone written agreement or by a labor union whose collective bargaining agreement expressly covers digital replica and AI system uses.

Applies retroactively to all existing and past agreements.

Requires any person currently under or who has entered into a covered agreement to notify the individual in writing by January 1, 2025 that the provision is unenforceable.
