SB3727 - Patient Access to Pharmacy Protection Act

• Prohibits pharmaceutical manufacturers from denying, restricting, or conditioning the acquisition or delivery of 340B discount program drugs to eligible covered entities or their contract pharmacies, unless prohibited by federal law.

• Prevents manufacturers from imposing restrictions on 340B covered entities' ability to contract with or designate contract pharmacies, including restrictions based on number, location, ownership, or type of pharmacy.

• Prohibits manufacturers from requiring 340B covered entities or contract pharmacies to submit pricing data, implement inventory management requirements not mandated by state or federal agencies, or provide unrequired data or information.

• Authorizes the Department of Financial and Professional Regulation to enforce the Act through investigations and subpoenas, and allows the Attorney General or State's Attorneys to seek injunctive relief, damages, and civil penalties up to $10,000 per violation.

• Permits 340B covered entities and contract pharmacies to bring civil actions for violations, including claims for damages, civil penalties up to $10,000 per violation, and reimbursement for attorney's fees and costs.
