IL SB3788

Creates the Police Mental Health Office Division in the Illinois Municipal Code requiring Chicago Police Department to establish mental health offices in 2 of its districts, Peoria Police Department to establish one office, and Springfield Police Department to establish one office by October 1, 2024, subject to appropriation.

Each mental health office shall be overseen by the police department's mental health ombudsman or other designated person in coordination with the bargaining unit representing peace officers and must focus on mental health and addiction services for peace officers and crisis responders.

Requires social workers in the offices to have or be working toward certification as a Certified Alcohol and Other Drug Counselor and must inform clients of confidentiality protections before providing services.

Protects communications with social workers as privileged and confidential under applicable law and prohibits adverse employment action against social workers for protecting such confidentiality.

Limits home rule municipalities from regulating police department mental health offices in a manner inconsistent with this Division; effective July 1, 2024.
