SB3962 Summary

• Amends Section 24-1.9 of the Criminal Code to require destruction of endorsement affidavits and related information if assault weapon provisions are found unconstitutional by a court with all appeals exhausted or expired.

• The Illinois State Police and any law enforcement agency must immediately and permanently destroy each endorsement affidavit and all collected information upon final judicial determination of unconstitutionality.

• Applies to affidavits submitted by persons seeking to lawfully possess assault weapons, .50 caliber rifles, and .50 caliber cartridges under the existing ban enacted January 10, 2023.

• Does not change the underlying assault weapon prohibitions or exemptions for law enforcement, military, security personnel, and other authorized parties.
