Expands emergency placement options for students with disabilities to include nonpublic day facilities in addition to residential facilities not approved by the State Board of Education, with student-specific emergency approval required

Allows facilities to demonstrate staff competency through experience or requisite qualifications as an alternative to requiring appropriate teacher licensure for emergency placement approval

Grants the State Board of Education's impartial due process hearing officer jurisdiction to resolve disputes over emergency placements, facility selection, and whether approved facilities are appropriate alternatives to non-approved facilities

Requires IEP teams reviewing emergency placements every 3 years to consider whether transferring to an approved facility would be unduly disruptive to the student's educational progress before requiring such a transfer

Eliminates the requirement for prior State Superintendent approval for transportation to residential schools more than once per term if additional home visits are required by the facility
