IL HB1198

Amends the Illinois Probate Act of 1975 to require courts to appoint the State Guardian or county public guardian when guardianship petitions for persons with disabilities are filed by corporations, nonprofit organizations, or other entities with no legally recognized relationship to the alleged disabled person

Applies to both temporary and permanent guardian appointments for the person, their estate, or both

Creates an exception for counties that do not have a sitting county public guardian

Maintains existing requirements that guardianship must be demonstrated by clear and convincing evidence and should only be used to the extent necessitated by the individual's actual limitations
