IL HB1280

Creates the Uniform Deployed Parents Custody and Visitation Act to address child custody arrangements when a parent is deployed for military service lasting more than 90 days but less than 18 months

Allows deploying parents and the other parent to enter temporary written agreements granting custodial responsibility during deployment, or permits courts to issue temporary custody orders after deployment notification

Enables deploying parents to grant caretaking authority or limited contact to adult family members or adults with close relationships to the child during deployment

Requires all temporary custody agreements and orders to automatically terminate within 60 days after the deploying parent returns from deployment and provides notice, unless terminated earlier by court order or mutual agreement

Prohibits courts from considering a parent's past or future deployment as a factor against them in custody determinations, though courts may consider significant impacts on the child's best interests

Requires deploying parents to notify the other parent within 7 days of receiving deployment orders and mandates expedited court hearings for custody motions filed before deployment
