IL HB1359

Prohibits local governments from enacting or enforcing ordinances that ban or unreasonably restrict property owners from growing Illinois native plant species or maintaining native landscapes on privately owned residential land

Defines "Illinois native species" as plants growing in Illinois prior to European settlement, including trees, shrubs, vines, ferns, flowers, forbs, sedges, and grasses

Protects native landscaping in front, back, and side yards, as well as on farms, rural properties, corporate campuses, school campuses, and large estates

Allows local governments to maintain ordinances preventing landscaping from interfering with public transportation, vehicular traffic, sight lines at driveways and entrances, or from crossing sidewalks and property boundaries

Limits home rule authority, preventing municipalities from regulating native species and landscapes in ways inconsistent with the Act
