IL HB1425

Amends the Probate Act of 1975 to require courts to give first consideration to appointing a qualified family member as guardian of a disabled adult when the family member petitions for guardianship

Exception applies if the person with a disability has previously designated a different person to serve as their guardian under Section 11a-6

Defines "family member" as any person related to the person alleged to have a disability

Maintains that the paramount concern in guardian selection remains the best interests and well-being of the person with a disability

Court retains discretion in final guardian selection and must still consider the disabled person's preferences and the proposed guardian's qualifications
