Requires third-party food delivery platforms and online ordering platforms to give consumers the option to request single-use foodware (utensils, napkins, condiment packets, etc.) rather than automatically including it with orders

Restaurants using these platforms may only provide single-use foodware when explicitly requested by the customer through the platform

Exempts safety-related items like lids and cup sleeves for hot beverages over 170°F, vending machines, manufacturer-prepackaged items, charitable food establishments, restaurants at O'Hare and Midway airports, and drive-through orders

First violation results in a warning notice; subsequent violations carry civil penalties up to $25 per day, with a maximum of $250 per year per entity

Preempts local governments, including home rule units, from enacting their own regulations on single-use foodware; takes effect July 1, 2026
