IL HB1709

Creates the Local Accessory Dwelling Unit Act, prohibiting local governments in Illinois from banning the construction or use of accessory dwelling units (ADUs) on residential properties

Defines ADUs as attached or detached residential units with complete independent living facilities located on the same lot as a primary residence, including efficiency units and manufactured homes

Sets minimum standards for efficiency units at 150 square feet for occupancy by no more than 2 persons

Allows local governments to impose reasonable regulations on ADU size and location similar to other accessory structures, but only if such regulations do not effectively prohibit ADUs

Limits home rule authority by requiring all local governments, including home rule units, to comply with the Act's provisions
