IL HB1773

Creates the new offense of "mail and mail depository theft" under the Criminal Code of 2012, making it illegal to take, hold, conceal, or destroy mail addressed to another person with intent to defraud or deprive the addressee of their mail

First offense is a Class A misdemeanor; second or subsequent offenses are elevated to a Class 3 felony

Defines "mail" broadly to include letters, postal cards, packages, bags, or any sealed article addressed to a person

Applies regardless of whether the individual whose mail is targeted is alive or deceased at the time of the violation

Does not preclude additional charges for other crimes committed using stolen mail or during the commission of mail theft
