IL HB2371

Amends the Illinois Insurance Code to explicitly include dental insurance in the existing right of assignment provision, allowing insured individuals to assign their dental insurance policy rights to dental care providers and facilities

Requires insurers, HMOs, dental service plan corporations, dental insurers, and third party administrators to pay claims directly to dental care providers or facilities when an enrollee assigns their claim, including any interest for failure to pay within 30 days

Adds a new Section 38.1 to the Dental Service Plan Act requiring all dental service plan corporations to comply with the assignability provisions of Section 370a of the Illinois Insurance Code

Updates the Health Maintenance Organization Act, Limited Health Service Organization Act, and Voluntary Health Services Plans Act to include compliance with Section 370a regarding claim assignment requirements

Takes effect January 1, 2026
