Requires county boards or municipal governing bodies to conduct pollution control facility siting hearings in a manner accessible to individuals with disabilities and non-native English speakers

Mandates that upon completion of siting hearings, the county board or municipal governing body must certify compliance with accessibility requirements as part of the written record

Establishes that the accessibility certification in the hearing record constitutes prima facie evidence of compliance, and claims of noncompliance cannot serve as grounds for appeal under Section 40.1

Authorizes the Department of Transportation to conduct traffic impact studies that include studies of emissions associated with traffic for proposed pollution control facility locations

Permits the Department of Transportation to charge a fee to cover costs of conducting emissions studies requested by governing authorities
