IL HB2538

Requires the Department of Human Services to request a wellness check within 6 months of learning that an adult with a developmental disability has lost a parental guardian

Applies to adults with developmental disabilities who were living with their parental guardian or living independently at the time of the guardian's death

Wellness checks must be conducted by designated adult protective services agencies or provider agencies under the Adult Protective Services Act

Checks must verify the adult is not experiencing or at imminent risk of abuse, neglect, exploitation, or self-neglect

Requires establishment of mandatory standards for emergent casework and follow-up services to prevent harm or death to the affected adult
