Creates the new offense of "sexual misconduct with a student" in the Criminal Code of 2012, making it illegal for school employees to engage in sexual misconduct with any student who attended the school while they were employed there

Defines "sexual misconduct" broadly to include verbal, nonverbal, written, electronic communication, or physical activity directed toward establishing a romantic or sexual relationship with a student

Applies to employees of public and private elementary, secondary, and K-12 schools, regardless of the student's age at the time of the offense

Student consent is not a valid defense, and students are deemed legally incapable of consenting when they attended the school during the employee's employment

Violation is a Class 3 felony, with mandatory forfeiture of school employment and permanent ban from future school employment upon conviction
