Food dispensing establishments may only provide single-use foodware (utensils, napkins, condiment packets, stirrers, etc.) upon customer request or at self-service stations for delivery and take-out orders, not automatically included

Establishments must offer options for customers to affirmatively request single-use foodware across all ordering platforms including apps, websites, phone orders, and in-person ordering

Exemptions apply to hot beverage lids and safety items, vending machines, pre-packaged items, charitable food establishments, airport food vendors, and medical facilities including nursing homes

Violations result in civil penalties of $200 to $2,000 per day, with the Agency required to issue at least 2 notices by certified mail before assessing penalties

Civil penalties collected will be deposited into the Solid Waste Management Fund to expand climate-related and pollution-related programs
