Expands the definition of "covered employee" under the Transportation Benefits Program Act to include all employees of covered employers, removing the previous requirement that employees work an average of at least 35 hours per week

Adds a new definition for "construction industry" covering a broad range of activities including constructing, repairing, demolishing, landscaping, painting, and maintenance of buildings, roads, bridges, and other structures, as well as snow plowing and refuse collection

Exempts construction industry employers from the Act's requirements for employees covered by a bona fide collective bargaining agreement

Preserves existing collective bargaining rights, allowing unions to negotiate wages and conditions exceeding the Act's minimum standards and permitting explicit waivers of the Act's requirements in collective bargaining agreements
