IL HB3733

Expands the definition of "gambling device" to include electronic machines that award credits with removal tracking capabilities and offer entry into chance-based contests, sweepstakes, or promotions tied to purchases or receipt of coupons/vouchers redeemable for items of value

Removes the Video Gaming Act exemption that previously allowed unlicensed game devices if the activity was not considered gambling under the Criminal Code

Makes gambling offenses involving the newly defined devices a Class 4 felony, regardless of whether it is a first offense (standard gambling is a Class A misdemeanor for first offenses)

Prohibits possession or operation of devices that award credits dependent on chance and contain circuitry capable of removing and recording credit removal

Explicitly states legislative intent to prohibit any mechanism that attempts to avoid being classified as a gambling device through subterfuge or pretense
