IL HB4285

Amends the Criminal Code of 2012 and Unified Code of Corrections to narrow the application of the 15-year sentence enhancement for committing various offenses "while armed with a firearm"

Requires the defendant to have been "personally armed with the firearm" during the offense for the 15-year enhancement to apply, rather than the enhancement applying when any participant was armed

Affects sentencing for multiple serious felonies including attempt to commit first degree murder, intentional homicide of an unborn child, aggravated kidnapping, aggravated criminal sexual assault, predatory criminal sexual assault of a child, aggravated battery, armed robbery, aggravated vehicular hijacking, and home invasion

Does not change the 20-year enhancement for personally discharging a firearm or the 25-year to natural life enhancement for discharging a firearm that causes great bodily harm, permanent disability, or death
