Assisted living establishments, shared housing establishments, community living facilities, and life care facilities may only refer residents to home services providers licensed under the Home Health, Home Services, and Home Nursing Agency Licensing Act.

Facilities violating the referral requirement face civil penalties of $1,000 per violation, recoverable through civil action by the Attorney General.

The Department of Public Health must distribute a one-page, 8.5 by 11 inch public safety announcement flyer (minimum 12-point type) to each covered facility, which must be posted prominently for visitors.

Required flyer content includes information about choosing caregivers, differences between licensed and unlicensed providers, risks of unlicensed providers, and how to verify agency licensure with the State.
