Unit owners in condominiums and common interest communities may remove Illinois Designated Noxious Weeds and Illinois Designated Exotic Weeds without first obtaining permission from their homeowners association

The Department of Natural Resources maintains the official list of which weeds qualify as noxious or exotic under this provision

Any provisions in an association's community instruments (bylaws, declarations, rules) that require permission for removing these designated weeds are automatically null and void

Amends both the Common Interest Community Association Act (765 ILCS 160/1-30) and the Condominium Property Act (765 ILCS 605/18 and 18.4)
