Transfers authority for fingerprint-based criminal history checks on day care providers from the Department of Children and Family Services to the Department of Early Childhood, effective July 1, 2026

Applies to day care centers, part day child care facilities, day care homes, and group day care homes

Requires all license applicants, employees, and volunteers to authorize investigations into criminal charges and their dispositions, with fingerprints submitted to Illinois State Police for checking against state and federal databases

Allows probationary hiring of employees or volunteers after receiving a qualifying result from either the FBI fingerprint check or the Illinois State Police check combined with checks from states where the person resided in the preceding 5 years

Mandates that probationary hires must be supervised at all times by someone who has fully cleared all background check requirements
