Beginning October 1, 2026 (rate year 2027), modifies the Medicaid inpatient utilization rate calculation used to determine hospital eligibility for disproportionate share adjustment payments.

Excludes from both the numerator and denominator of the utilization rate all inpatient days reimbursed by the Department of Human Services for mental health services provided under Section 104-17 of the Code of Criminal Procedure of 1963.

Section 104-17 services relate to court-ordered mental health evaluations and treatment for defendants in criminal proceedings, which are contracted through the Department of Healthcare and Family Services.

Amends Section 5-5.02 of the Illinois Public Aid Code (Medical Assistance Article) governing hospital reimbursements.

Takes effect immediately upon becoming law.
